End User License Agreement

This End User License Agreement ("EULA" or "Agreement") is between you and SHORELINES EXPLORER LTD ("we," "us," "our," or "Shorelines Explorer") for the iPhone application Shorelines Explorer (the "Application"), including updates and content shipped inside it.

By downloading, installing, or using the Application, you agree to this EULA. If you do not agree, do not install or use it. The website is governed by the Terms and Conditions. Privacy is described in the Privacy Policy.

1. Purpose of the Application

Shorelines Explorer is a visit journal and area guide for four Ontario properties. It is for personal record-keeping and for reading the bundled guide. It does not provide real-money gambling. It does not:

Property names in the guide identify places. They are not a game, and they are not an invitation to wager.

2. License Grant

If you comply with this Agreement, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the Application on an iPhone you own or control, for personal, lawful, non-commercial use. The Application is licensed, not sold. All rights not granted stay with SHORELINES EXPLORER LTD and its licensors.

3. Eligibility

You may use the Application only if you are at least 18 years old, or older if your law requires it. You confirm that you have the legal capacity to agree and that your use is permitted where you are. The Application is not directed to children.

4. No Real-Money Gambling

You cannot use the Application to place a real-money bet, deposit money, withdraw money, receive winnings, or transfer a balance. Counts on the trail are not a balance. We are not a gambling operator.

5. No Virtual Currency

The Application does not provide coins, chips, credits, tokens, or any virtual item that functions as currency. Nothing displayed in the trail can be purchased from us, sold, withdrawn, or redeemed.

6. Your Content

Journal text and photographs you add remain yours and stay on the device. We do not claim ownership of them. You are responsible for having the right to store a photograph you attach. Do not use the Application to store unlawful content.

7. Guide Content

The guide is our content, bundled in the Application. It may mention third-party places and marks. We do not own those marks and we do not operate those places. Place details can become outdated. The Application does not embed third-party games.

8. License Restrictions

Except where the law expressly allows, you must not copy, sell, rent, lease, sublicense, publish, or distribute the Application; modify it; circumvent its technical limits; or use it to build a competing guide by extracting the bundled text in bulk. You must not remove credits or legal notices.

9. Ownership and Trademarks

We and our licensors own the Application, its interface, and the guide text we authored. "Shorelines Explorer" as used for this Application is our product name. Names of casino properties are trademarks of their owners. You receive no right in those marks.

10. Updates and Compatibility

We may issue updates through the App Store. An update may change features or the guide. The Application is for iPhone in portrait. It is not licensed for Android. A future iOS release may affect compatibility. We do not promise support for every device Apple still sells.

11. Network Use

The journal and the bundled guide work on the device without an account. Opening the privacy policy or the terms loads https://shrexplorerandcasino.com and needs a connection. We are not responsible for carrier charges.

12. Apple App Store Terms

You downloaded, or will download, the Application from Apple. Apple's terms apply to the store relationship. This EULA is between you and SHORELINES EXPLORER LTD, not Apple. Apple is not responsible for the Application or its support, except that if a non-waivable warranty is breached Apple may refund the price you paid Apple, if any. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it. You represent that you are not in a country subject to a U.S. government embargo or on a U.S. denied-party list, as Apple's standard terms require. Maintenance and support are ours, not Apple's, and we may not offer any.

13. Support

Support is by email at support@shrexplorerandcasino.com. We aim to reply within two working days. We do not promise a particular fix or a phone line.

14. Privacy and Deletion

The Privacy Policy explains on-device storage. You may delete entries or erase the journal in Settings. Deleting the Application removes its local store from the phone, subject to backups you control. There is no online account for us to close.

15. No Purchase Required

The Application does not require a purchase inside the app. If Apple charges for the download, that transaction is with Apple.

16. Feedback

If you send a suggestion, you allow us to use it without obligation to you, except that we will not publicly attribute a private journal excerpt you did not ask us to publish.

17. Open-Source Software

The Application includes third-party software, including the Jost typeface under the SIL Open Font License. Those components remain under their own licenses. Nothing in this EULA limits rights you have in those components under their licenses.

18. Availability

We may stop distributing the Application. We do not promise that a given place, photo, or sentence in the guide will remain. Technical problems can interrupt the in-app browser that loads legal pages. The on-device journal does not depend on our servers.

19. No Warranty

The Application is provided "as is" and "as available," without warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law. We do not warrant that the guide is complete or current, or that a visit will match a description. Consumer rights that cannot be waived still apply.

20. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, lost data, or travel costs. Our aggregate liability arising out of the Application is limited to the amount you paid Apple for the Application in the three months before the claim, or fifty U.S. dollars if you paid nothing, whichever is greater. The limit does not apply where the law forbids it, including fraud and death or personal injury caused by negligence where a cap is prohibited.

21. Indemnity

You will indemnify us against claims arising from your unlawful use of the Application or from content you add and then publish, except to the extent caused by our breach of law.

22. Termination

This license ends if you delete the Application or if you break this Agreement. We may stop offering updates. When the license ends, you must stop using the Application. Sections on ownership, disclaimers, liability, and Apple's role survive.

23. Changes

We may update this EULA by posting a new version at https://shrexplorerandcasino.com/eula. The date at the top will change. Continued use after an update takes effect means you accept the new EULA where the law allows that.

24. Export and Government Use

You must comply with export laws that apply to you. If you are a government end user, the Application is licensed as commercial computer software with only the rights stated in this EULA, to the extent that framing is allowed.

25. General

Contact us before starting a formal dispute, at the email below. We do not set a governing court in this EULA. Mandatory local consumer protections remain. If a clause is unenforceable, the rest stays in force. A waiver must be in writing. You may not assign this license. We may assign it to a successor. This EULA, together with the Terms, the Privacy Policy, and the Cookie Policy, is the whole agreement about the Application. English controls. Apple is a third-party beneficiary only as section 12 states. There is no partnership between you and us, and no partnership between us and the properties named in the guide.
